Hmm...California court to hear threatening poetry case. I think people need to really revise what their definition of threat is. "I'm going to kill you" -- that's a threat. "I could kill you" appears to simply be a declarative statement that anyone could make, inasmuch as anyone has access to guns, knives, poisons, pianos which can be dropped from great heights, etc.
